1) Opening up Markets
Technical-legal advice for the acquisition of a permit, license, authorization or concession to grow, manufacture derivatives and/or market finished products from cannabis.
Scope of the service:
- We carry out an analysis of advantages and disadvantages in relation to the application and obtaining of the different licenses, permits, authorizations or concessions existing in the country of interest.
- We fully accompany the enterprises, ranging from the preparation and review of the documents (requirements) that must be submitted to the regulatory authority, to the decision on the granting of the permit, license, authorization or concession.
- We respond to requests, evidence, and clarifications for information made by the authority and, if applicable, file appeals against administrative acts.
2) Sailing in the Market
Permanent comprehensive advice to persons authorized to grow cannabis, manufacture derivatives or elaborate and commercialize finished products and cannabis-based medicines
Scope of service:
We provide comprehensive support to the company, in the preparation and review of documents related to regulatory matters that it must supply in the field of cultivation, manufacture and commercialization of cannabis-based products. Among the documents to be prepared or reviewed are:
- Alliances and commercial contracts.
- Outsourcing of activities.
- Quota requests.
- License modification requests.
- Permits and procedures before control entities.
- Foreign trade procedures.
3) Legal opinion
Legal advice to entrepreneurs and companies on the convenience of developing productive cannabis projects in a certain country, or on another topic of interest to them.
Scope of service:
- We elaborate a concept that explains the advantages and disadvantages of entering a certain market where there is a regulation on medical, industrial and/or adult-use of cannabis. Furthermore, if required, the technical and legal strengths and weaknesses are expressed in relation to the development of the cannabis production project in the country on which the consultation is carried out.
- We solve, through a concept, particular queries that the client makes, different from the topic previously addressed on market penetration.
4) Sanctioning Legal Defense (Colombia)
We provide legal support to licensees immersed in a sanctioning administrative procedure for license suspension or cancellation (condition resolution).
Scope of service:
We present discharges, requests and provision of evidence, closing arguments, procedural nullities and filing of appeals, as well as any additional action that is required for the defense of the client.
5) Goverment Support
Advice to governments for the creation of new regulatory frameworks on cannabis and/or modifications to them.
We advise the public administration and/or the legislative body of the country interested in the creation and implementation of regulatory frameworks or modifications to them, in relation to seeds, plant material, cannabis, derivatives, products and drugs based on medical, industrial and/or adult-use of cannabis.
Scope of service:
This service includes support in the preparation of bills or administrative acts, both in the legal and technical aspects.
6) Unit Services
We prepare the following documents, so that they are filed by the client at their own risk and expense, also taking care of their follow-up:
- Applications for permits, licenses, authorizations or concessions, modifications and other procedures before regulatory entities.
- Follow-up of requests for permits, licenses, authorizations, concessions or modifications made by the client.
- Response to requirements, tests, clarifications and requests for information made by the regulator.
- Quota requests.
- Follow-up on quota requests made.
- Administrative appeals against unfavorable decisions issued by Colombian regulatory authorities, and immediate legal protections for fundamental rights (tutela).
- Permits and authorizations for foreign trade activities.
